FOUNDATION Terms of Service

These Terms govern your use of try-foundation.com and purchases from FOUNDATION. By visiting the site or ordering, you agree to these Terms and our Privacy, Return & Refund, and Shipping policies.
1. About us
The store operates under the FOUNDATION brand. “FOUNDATION,” “we,” “us,” and “our” refer to the store operator. Questions may be sent to tryfoundation.com@gmail.com.
2. Eligibility and information
You must be legally capable of entering a binding contract in your jurisdiction to order. You agree to provide current, complete, and accurate account, billing, payment, and delivery information. You are responsible for protecting your account credentials.
3. Products and jewelry care
We sell jewelry and related accessories. We aim to display descriptions, colors, measurements, materials, finishes, packaging, and prices accurately. Screen settings, lighting, production variation, and manufacturing updates may cause reasonable differences.
Review the product page before purchase and follow the supplied care guidance. Plated, polished, and imitation-pearl finishes can change gradually with wear. Individual metal sensitivities differ; discontinue wear if irritation occurs. Jewelry may contain small parts and is not a toy.
4. Availability and store changes
Products, offers, and quantities may be limited. We may update, replace, restrict, or discontinue products and may limit sales by customer, location, jurisdiction, or order quantity where lawful.
5. Orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean acceptance. We may refuse or cancel an order because of stock errors, payment failure, suspected fraud, inaccurate information, shipping restrictions, obvious pricing errors, or other legitimate operational reasons. If we cancel after payment, we will refund the affected amount.
6. Prices, taxes, and payment
Prices are shown in the currency displayed at checkout. Applicable taxes, shipping, duties, and charges are shown where possible. Payment must be authorized before fulfillment. We may correct obvious pricing or listing errors where permitted by law.
7. Shipping, delivery, and returns
Processing and delivery windows are estimates. Carrier delays, customs, weather, public holidays, high demand, incorrect addresses, and events outside our control may affect delivery. Returns, refunds, and cancellations are governed by our Return & Refund Policy. Your mandatory consumer rights are not limited.
8. Promotions
Discounts, bundles, gifts, and limited-time offers may have additional terms. Codes must be applied at checkout unless stated otherwise, cannot usually be combined, have no cash value, and may be withdrawn or corrected where lawful.
9. Intellectual property
The site and its text, graphics, product imagery, brand elements, and layout are owned by or licensed to us and protected by applicable law. You may use the site for personal shopping only and may not reproduce, scrape, distribute, modify, sell, or exploit its content without permission.
10. Reviews and user content
If you submit content, you confirm that you may share it and that it is accurate, lawful, and non-infringing. You grant us a non-exclusive, worldwide, royalty-free license to use and display it for store, support, and marketing purposes. We may moderate inappropriate or misleading content.
11. Prohibited use
You may not use the site to break the law, infringe rights, submit false information, transmit malware, interfere with security, scrape data without permission, impersonate another person, abuse discounts or returns, or attempt unauthorized access.
12. Third-party services
The store may use services such as Shopify, payment providers, carriers, analytics tools, and social platforms. Third-party services are governed by their own terms and policies.
13. Disclaimers and liability
To the extent permitted by law, the site is provided on an “as available” basis. We do not guarantee uninterrupted access. We are not liable for indirect, incidental, special, punitive, or consequential loss to the maximum extent permitted by law. Nothing excludes liability or consumer rights that cannot legally be excluded.
14. Indemnity, suspension, and severability
Where permitted by law, you agree to indemnify us against reasonable losses caused by unlawful use, breach of these Terms, or infringement. We may suspend access or cancel orders for material breach, fraud, security threats, or legal risk. If a provision is unenforceable, the remainder remains effective.
15. Governing law
These Terms are governed by the laws of Switzerland, without limiting mandatory consumer protections or jurisdiction rights that apply in your country of residence.
16. Changes and contact
We may update these Terms for operational, legal, or regulatory reasons. The version displayed when an order is accepted applies to that order.
